ADDENDUM TO DEER CREEK PROJECT RULE 23

Homeowners may plant flowers in the mulched areas adjacent to their unit and where applicable in the mulched areas along retaining walls. If they elect to do so, the homeowner shall accept all responsibility for maintenance including, but not limited to removal of dead plants, trimming of plants (so as not to impede safe passages along walkways), weeding in the mulched areas etc. Nothing may be planted or placed in the grassy areas or other common areas, such as driveways. No agriculture plants/crops may be planted anywhere, nor are they allowed in pots/buckets and placed in the mulched areas. Yard ornaments will be limited to five (5) only and may be placed in the mulch areas by the unit and mulch areas between the sidewalk and unit. A yard ornament is defined as an individual piece, family name plaque, garden signs, flags, bird feeders, and hanging baskets. One (1) flower pot may be placed in the center of the two garages for the purpose of planting flowers. They must be uniform in size, 14 inches in diameter and 24 inches in height and will not be counted as one (1) of the five (5) ornaments allowed. Also, Security system signs are allowed to be placed in mulch and landscape lighting can be placed. These items will not count towards your limit of five (5) ornaments. An outdoor bench can be placed in the walkway leading to your front door as long as it does not impede a safe passage into your unit. This item will be counted as one (1) of the five (5) yard ornaments allowed. Also, any flower stands/pots in the entrance way will be counted as one (1) ornament as well. The cost of such maintenance after notice to the owner shall become a special assessment against the affected owner.
